1. Agreement to Terms

By accessing or using Super Cool Gear (supercoolgear.com), you agree to these Terms and Conditions. If you disagree with any part of these terms, you may not use our service.

2. Definitions

• "Service" refers to Super Cool Gear (supercoolgear.com)
• "Design" refers to any t-shirt design created using our platform
• "Gallery" refers to user-created collections of designs
• "User" refers to anyone who uses our Service
• "Designer" refers to users who create and/or sell designs

3. User Accounts

3.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate, current information
• You are responsible for maintaining account security
• One person may maintain multiple accounts for different galleries

3.2 Subscription Tiers

• Free tier: No cost, basic design capabilities
• Basic tier ($20/year): One gallery, earning capabilities
• Plus tier ($80/year): Up to 3 galleries, additional features
• Pro tier ($240/year): Up to 12 galleries, maximum features
• Features and limitations as described in current subscription documentation

3.3 Account Termination

We may terminate or suspend your account immediately for:

• Violation of these terms
• Illegal activities
• Systematic abuse or harassment
• Multiple copyright violations
• Payment fraud or chargebacks
• False representation or impersonation

4. Design Creation and Ownership

4.1 Your Designs

• You retain ownership of designs you create
• Once a design sells, it becomes frozen and cannot be modified
• You grant us license to display and produce your designs
• You may delete unsold designs at any time

4.2 User-Uploaded Content

• You warrant you have rights to use all uploaded content
• You are solely responsible for copyright/trademark compliance
• You indemnify Super Cool Gear against claims related to your content
• We may remove content that violates these terms

5. Sales and Earnings, (plans Basic and above)

5.1 Revenue Structure

• Designers earn 10% of base price automatically
• Designers earn 80% of any markup they add
• Maximum markup is $100 per item
• Designers get 10% discount on their own designs

5.2 Payout Terms

• Minimum payout threshold: $100
• 30-day holding period on earnings
• Payments via PayPal only
• One pending payout request at a time allowed

6. Production and Shipping

6.1 Manufacturing

• All products manufactured by Printify
• Color reproduction may vary slightly
• Production typically takes 2-3 business days

6.2 Shipping

• Standard (5-7 days) and Express (2-3 days) options
• Shipping rates vary by destination
• Customer responsible for correct shipping information
• International customs fees are buyer's responsibility

7. Returns and Refunds

• Returns accepted within 30 days of delivery
• Item must be unworn and unwashed
• Customer pays return shipping
• Refund processed within 5 business days of return receipt
• Original packaging preferred but not required

8. Gallery Embedding

• Galleries may only be embedded on sites you control
• No modification of gallery code or appearance
• No framing that suggests false affiliations
• No embedding in inappropriate contexts
• We reserve right to disable embedding if misused

9. Prohibited Content

All content must comply with Printify's Terms of Service (Section H, Item 6). Any content meeting their prohibited criteria may result in the termination of your account.

10. Limitation of Liability

• Service provided "as is"
• No warranty of continuous service
• Not liable for production delays
• Maximum liability limited to purchase price
• Not liable for third-party actions

11. Dispute Resolution

• Governed by Washington State law
• Disputes subject to binding arbitration
• Arbitration to be conducted in Washington State
• Class action waiver
• Small claims court matters excluded from arbitration

12. Changes to Terms

We reserve the right to modify these terms. Users will be notified of significant changes via:

• Email notification
• Site announcement
